By creating an account, publishing a portfolio, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Showfolio is a free tool that lets photographers build and publish an online portfolio. The Service is provided free of charge, on an “as is” and “as available” basis. We may add, change, or remove features at any time.

2. Eligibility and accounts

• You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
• You are responsible for the information you provide and for keeping it accurate.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• Notify us promptly at alan.k@imagen-ai.com if you suspect any unauthorized use of your account.

3. Your content

You retain all ownership rights to the photos, text, and other materials you upload or publish (“Your Content”). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating, providing, and promoting the Service.

You represent and warrant that:

• You own Your Content or have all necessary rights, licenses, and permissions to publish it.
• Your Content does not infringe the intellectual property, privacy, or other rights of any third party.
• You have obtained any consents required from people who appear in your photos.

4. Acceptable use

You agree not to use the Service to:

• upload or publish unlawful, infringing, defamatory, or harmful content;
• post sexually explicit material involving minors, hateful content, or content that promotes violence;
• impersonate any person or misrepresent your affiliation;
• distribute malware, spam, or attempt to gain unauthorized access to the Service or its systems;
• interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure.

5. Removal, suspension, and shutdown

We reserve the right, at our sole discretion and without prior notice, to remove or delete any portfolio, profile, account, or content, to suspend or terminate your access to the Service, and to modify, suspend, or permanently discontinue (shut down) the Service in whole or in part, at any time and for any reason or no reason.

Because the Service is provided free of charge, we are under no obligation to retain, back up, or return Your Content, and we will not be liable to you or any third party for any such removal, suspension, termination, or shutdown. You are solely responsible for keeping your own backups of Your Content.

6. Availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content will be preserved. Scheduled or unscheduled downtime may occur.

7. Intellectual property

The Service itself, including its software, design, templates, logos, and the “Showfolio” name, is owned by us or our licensors and is protected by intellectual property laws. Except for Your Content, you may not copy, modify, or create derivative works from the Service without our permission.

8. Third-party services

The Service relies on and may integrate third-party providers (for example, hosting and storage, email delivery, analytics, and embedded video from providers such as YouTube and Vimeo). Your use of those features may be subject to the third parties’ own terms and privacy practices, and we are not responsible for third-party services.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising out of Your Content or your violation of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
